Terms and Conditions – DaMa Naturals

These Terms and Conditions apply to the use of the DaMa Naturals online store and to all orders placed through our online store.
By placing an order, you confirm that you have read and understood these Terms and Conditions.

DaMa Naturals is a business established in Belgium.
2. Applicability
These Terms and Conditions apply to every offer made by DaMa Naturals and to every agreement concluded between DaMa Naturals and the customer through our online store.
All mandatory statutory consumer rights remain fully applicable to consumers.
3. Products
DaMa Naturals sells carefully selected cosmetics and personal care products.
We make every effort to display product descriptions, ingredients, contents, images and other product information as accurately as possible.
Product colours and appearance may vary slightly from reality due to screen settings or the device used.
Product information and packaging may be changed by the manufacturer. Therefore, before use, always check the information and instructions on the packaging of the product you have received.
If you have a known allergy or sensitivity to an ingredient, we recommend carefully checking the ingredient list on the packaging before use.
4. Orders
When you place an order, you will receive an electronic confirmation.
DaMa Naturals reserves the right to refuse or cancel an order where there is a valid reason to do so, for example:
- when a product is found to be unavailable;
- in the event of an obvious pricing or product information error;
- where fraud or misuse is suspected;
- when payment cannot be processed.
If we cancel an order that has already been paid for, we will refund the amount due.
5. Prices and VAT
All prices in our online store are displayed in euros (€).
Prices displayed to consumers include the applicable VAT, unless expressly stated otherwise.
Any shipping costs will be clearly displayed before you complete your order.
The price applicable at the time you place your order will apply to that order.
6. Payment
Payment is made using the payment methods offered during checkout in our online store.
The available payment methods may depend on the country, order value and payment service used.
Payments are processed through Shopify Payments and/or other available payment service providers.
DaMa Naturals reserves the right to process an order only after payment has been successfully confirmed.
7. Delivery
We currently deliver to the countries and regions displayed as available shipping destinations during checkout.
The applicable shipping costs and estimated delivery times will be displayed before you complete your order.
The stated delivery times are estimates. We make every effort to dispatch and deliver orders within the indicated timeframe.
If a delivery is delayed, the consumer's statutory rights remain applicable.
The customer is responsible for providing a correct and complete delivery address.
8. Right of Withdrawal
When you purchase online from DaMa Naturals as a consumer, you generally have a statutory 14-day right of withdrawal, subject to the statutory exceptions.

DaMa Naturals also offers a voluntary 30-day return period, subject to the conditions described in that policy.
9. Cosmetics and Hygiene
For certain sealed cosmetics and personal care products, a statutory exception to the right of withdrawal may apply for reasons of health protection or hygiene if the seal has been broken after delivery.
This does not affect your statutory rights if a product is damaged or defective, has been incorrectly delivered or does not conform to the agreement.

10. Damaged, Incorrect or Defective Products

We will investigate the issue and, depending on the circumstances and your statutory rights, provide an appropriate solution.
11. Statutory Guarantee
Consumers are entitled to statutory guarantee rights in accordance with applicable Belgian and European legislation.
These Terms and Conditions do not limit these statutory rights.
12. Use of Cosmetic Products
Use our products in accordance with the instructions and warnings on the packaging and in the product information.
Discontinue use if a product causes an adverse reaction and seek professional advice if necessary.
DaMa Naturals is not liable for damage resulting from incorrect or improper use of a product, to the extent that such a limitation is permitted by law.
Nothing in these Terms and Conditions limits or excludes liability where this is not permitted under applicable law.
13. Intellectual Property
The content of our online store, including texts, design, logos, photographs and other materials, may be protected by intellectual property rights belonging to DaMa Naturals, manufacturers, Shopify or other rights holders.
This content may not be copied, distributed or used for commercial purposes without permission, except where permitted by law.
14. Privacy
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR).

15. Force Majeure
DaMa Naturals is not responsible for delays or failure to perform its obligations due to circumstances beyond our reasonable control, to the extent permitted by applicable law.
Consumers' statutory rights remain applicable.

17. Applicable Law
These Terms and Conditions and agreements with DaMa Naturals are governed by Belgian law, provided that this does not result in the loss of any mandatory consumer protection to which a consumer is entitled under applicable law.
Disputes will be dealt with by the competent courts in accordance with the applicable legal rules.
18. Changes
DaMa Naturals may amend these Terms and Conditions from time to time, for example when our services or applicable legislation change.
The most recent version will always be published on our website.
The Terms and Conditions applicable at the time an order is placed will apply to that order.
